1. Quality Complaints
These are primarily contractual claims, such as complaints about the services provided, or the condition of the hotel or accommodation. These may include:
  • Misleading or inaccurate holiday brochure descriptions of hotel and/or resort;

2. Personal Injury Claims
Under the Package Travel Regulations 1992, the tour operator becomes responsible for the faults of any of their suppliers or agents, who provide services which comprise part of the package holiday. The consumer, in qualifying cases, is therefore able to bring a claim in this country, despite the accident occurring abroad and even if the other party is foreign. This can be very important as, in most other countries, the successful party does not recover legal costs.
